KILLBOT END USER LICENSE AGREEMENT (EULA)

This End User License Agreement ("Agreement" or "EULA") governs access to and use of the KillBot service, software, websites, APIs, bot detection technologies, website protection systems, and related services (collectively, the "Service").

The Service is operated by Individual Entrepreneur Grigoriy Melnikov ("KillBot", "we", "us", "our", or the "Provider").

The Service is available through:

By registering an account, purchasing a subscription, integrating KillBot with a website, or otherwise using the Service, the customer ("User", "Customer", or "you") agrees to this Agreement.

If you use the Service on behalf of a company or other organization, you represent that you have authority to accept this Agreement on its behalf.

1. DEFINITIONS

1.1. KillBot. KillBot is a software service designed to detect automated traffic, behavioral bots, malicious requests, fraudulent activity, and other forms of automated or abusive website activity.

1.2. Website. "Website" means the KillBot websites available at kill-bot.net and my.kill-bot.net, including the customer dashboard and related interfaces.

1.3. Customer Website. "Customer Website" means a website, application, domain, or other Internet resource that the Customer connects to or analyzes using KillBot.

1.4. Project. "Project" means a Customer Website, domain, advertising campaign, or other Internet resource configured by the Customer for monitoring, analysis, bot detection, or protection through KillBot.

1.5. Account. "Account" means the Customer's registered KillBot account used to access the Service.

1.6. Service Content. "Service Content" includes KillBot software, source and executable code, bot detection algorithms, Browser Snapshots technology, databases, APIs, interfaces, designs, logos, trademarks, documentation, technical methods, and other intellectual property associated with the Service.

2. PURPOSE AND PROVISION OF THE SERVICE

2.1. KillBot provides software and infrastructure for detecting automated traffic and protecting websites from bots and other forms of automated or abusive activity. Depending on the selected configuration and subscription, KillBot may provide bot detection, traffic analysis, CAPTCHA challenges, traffic filtering, reverse proxy protection, analytics integration, technical visitor identification, API access, and other security functionality.

2.2. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, subject to the limitations contained in this Agreement.

2.3. KillBot does not guarantee that every bot will be detected or that every legitimate visitor will always be classified correctly. Automated traffic detection is probabilistic and depends on technical and behavioral characteristics available at the time of analysis.

2.4. The Customer is responsible for determining how KillBot should respond to detected or suspected automated traffic, including whether such traffic should be allowed, challenged, limited, redirected, or blocked.

3. REGISTRATION AND CUSTOMER ACCOUNT

3.1. To create an Account, the Customer must provide a valid username, email address, and password.

3.2. The Customer must provide accurate and current information where such information is required for account administration, billing, invoicing, legal compliance, or technical support. Additional company, billing, tax, or identity information may be requested when necessary for invoicing, contractual documentation, regulatory requirements, fraud prevention, or payment processing.

3.3. KillBot may request reasonable documentation necessary to verify information supplied by the Customer.

3.4. If the Customer provides materially false or misleading information, KillBot may suspend or terminate the Account.

3.5. The Customer is responsible for maintaining the confidentiality of account credentials and for activities performed through the Account. The Customer must notify KillBot promptly if unauthorized access to the Account is suspected.

3.6. Accounts may not be sold, transferred, or otherwise provided to third parties without prior authorization from KillBot.

3.7. A Customer may not create multiple trial accounts for the purpose of repeatedly obtaining free access to paid functionality.

4. PROJECTS AND USE OF THE SERVICE

4.1. After registration, the Customer may create Projects within the limits of the selected subscription plan.

4.2. The Customer may only connect websites, domains, applications, advertising accounts, or other resources that the Customer owns or is legally authorized to administer, monitor, or protect.

4.3. The Customer must not use KillBot:

  • in violation of applicable laws or regulations;
  • to interfere with the operation of KillBot or other systems;
  • to gain unauthorized access to third-party systems;
  • to create Projects involving unlawful content or activities;
  • to circumvent technical restrictions of the Service;
  • to reverse engineer, copy, reproduce, or attempt to extract proprietary KillBot detection technologies except where such restriction is prohibited by applicable law.

4.4. Automated scraping, extraction, or systematic copying of the KillBot Website, dashboard, documentation, proprietary databases, or Service Content without prior authorization is prohibited.

4.5. If the Customer receives access to the KillBot affiliate or referral program, the Customer must also comply with the applicable affiliate program terms.

5. SUBSCRIPTIONS, TRIAL ACCESS AND PAYMENT

5.1. KillBot may provide free or trial access to some Service functionality. KillBot determines which functionality is available during a trial and the duration of such trial.

5.2. Paid functionality is provided according to the subscription plan selected by the Customer.

5.3. Access to paid functionality requires timely payment. If a subscription expires or payment is not received, KillBot may suspend paid functionality or limit the Account to functionality available under a free plan, if such a plan is available.

5.4. The Customer may discontinue use of the Service by cancelling or not renewing the applicable subscription, subject to outstanding payment obligations.

5.5. Prices, subscription limits, and available functionality may change from time to time. Changes affecting an existing paid subscription will be communicated in advance where required by applicable law or contractual commitments.

5.6. Where a subscription is purchased through a third-party marketplace, including Alibaba Cloud Marketplace, billing, renewal, cancellation, taxes, and refunds may additionally be subject to the rules and procedures of that marketplace.

5.7. Refund requests are handled according to the applicable KillBot refund policy and, where the purchase was made through a third-party marketplace, the applicable marketplace procedures.

6. SERVICE AVAILABILITY AND SUPPORT

6.1. KillBot aims to make the Service continuously available, except during scheduled maintenance, emergency maintenance, infrastructure failures, security incidents, force majeure events, or circumstances outside KillBot's reasonable control.

6.2. Technical support is available for questions concerning installation, configuration, integration, troubleshooting, and operation of the Service.

6.3. KillBot may temporarily restrict or suspend a Customer Website if its traffic or usage creates an excessive technical load that threatens the stability or availability of the Service for other customers. Where reasonably possible, KillBot will attempt to offer an alternative configuration or service arrangement.

6.4. KillBot may establish reasonable technical limits for traffic volume, API requests, data processing, storage, or other resources according to the Customer's subscription plan.

7. BOT DETECTION, REPORTING AND ANALYTICS

7.1. KillBot may provide reports showing detected bots, legitimate visitors, CAPTCHA displays and completions, Browser Snapshots, technical identifiers, filtering actions, and other security-related statistics.

7.2. Where enabled by the Customer, KillBot may transmit classification information to third-party analytics or advertising platforms selected by the Customer, such as Google Analytics or other compatible services.

7.3. The Customer is responsible for its own configuration and lawful use of any third-party analytics, advertising, or monitoring service integrated with KillBot.

7.4. KillBot does not guarantee the accuracy, availability, rankings, visitor statistics, search engine positioning, advertising performance, or other results generated by third-party services.

8. TECHNICAL BROWSER DATA PROCESSING

8.1. KillBot is designed to detect automated traffic, malicious requests, behavioral bots, and other abusive activity. To perform these functions, KillBot may automatically analyze technical characteristics of a visitor's browser, device, network connection, and JavaScript execution environment.

8.2. Depending on the configuration and detection methods used, technical information may include information derived from browser APIs and objects such as:

  • window;
  • screen;
  • navigator;
  • HTML5 Canvas;
  • JavaScript runtime characteristics;
  • browser and device characteristics;
  • network and request information, including IP addresses where technically necessary;
  • security events and bot detection signals;
  • KillBot-generated technical identifiers.

Some of this information may constitute personal data or personal information under applicable data protection laws.

8.3. KillBot does not intentionally collect the content of:

  • information entered by visitors into Customer Website forms;
  • clipboard contents;
  • cookies belonging to unrelated third-party services;
  • webcam recordings;
  • microphone recordings;
  • personal files or documents stored on the visitor's device.

KillBot's browser analysis is designed to collect technical signals necessary for security and bot detection rather than the content of a visitor's personal communications or documents.

8.4. Technical data is processed for purposes including:

  • detecting automated traffic;
  • identifying characteristics associated with bot software;
  • preventing malicious or abusive activity;
  • protecting Customer Websites;
  • generating technical browser and software-environment identifiers;
  • investigating security events;
  • improving the accuracy and reliability of KillBot's detection mechanisms.

8.5. Visitor session data and technical detection data are retained only for the period reasonably necessary for these purposes. Operational visitor-level data is generally automatically deleted within approximately 14–21 days and, under normal operation, no later than 30 calendar days, unless a longer retention period is required by law, necessary to investigate abuse or a security incident, or specifically agreed with the Customer. Historical technical information retained during this period allows Customers to analyze previous visits and configure bot filtering rules.

8.6. KillBot Cookies. KillBot may create its own technical cookies where necessary for website protection and visitor access verification. These cookies:

  • are used for security and Service operation;
  • are not designed for advertising or cross-site behavioral tracking;
  • are not used to track visitors across unrelated Customer Websites;
  • operate within the context of the protected Customer Website;
  • generally expire within 24 hours;
  • are not designed to contain names, email addresses, telephone numbers, or other directly identifying profile information.

The treatment of technical cookie identifiers as personal data may vary by jurisdiction.

9. DATA PROCESSING AGREEMENT (DPA)

This Section 9 constitutes the Data Processing Agreement ("DPA") between KillBot and the Customer and forms an integral part of this EULA.

9.1. Scope. Where KillBot processes personal data on behalf of the Customer in connection with providing the Service, the Customer acts as the Controller or equivalent responsible party and KillBot acts as the Processor or Service Provider, to the extent those terms apply under applicable data protection law. Where applicable law uses different terminology, the parties' roles will be interpreted according to substantially equivalent concepts under that law.

9.2. Applicable Data Protection Laws. Each party will comply with data protection and privacy laws applicable to its processing activities. These may include, where applicable, the EU General Data Protection Regulation ("GDPR"), the UK GDPR, applicable U.S. state privacy laws, and other national or regional privacy and data protection requirements. Nothing in this Agreement is intended to require either party to comply with a law that does not otherwise apply to that party or processing activity.

9.3. Customer Instructions. KillBot will process Customer Personal Data only:

  • to provide and secure the Service;
  • according to the Customer's configuration and documented instructions;
  • as described in this Agreement;
  • as necessary to comply with applicable law.

The Customer's use and configuration of the Service constitute documented instructions to KillBot for purposes of processing necessary to provide the Service.

9.4. Categories of Data Subjects. Depending on how the Customer uses KillBot, data subjects may include:

  • visitors to Customer Websites;
  • Customer personnel;
  • authorized users of the Customer's KillBot Account.

9.5. Categories of Personal Data. Personal data processed through KillBot may include:

  • IP address and network information;
  • browser and device characteristics;
  • JavaScript environment characteristics;
  • security and bot-detection signals;
  • technical identifiers generated by KillBot;
  • timestamps and visit information;
  • CAPTCHA and security challenge events;
  • Account contact information supplied by the Customer.

KillBot is not intended for processing special categories of personal data or similarly sensitive information submitted through Customer Website forms.

9.6. Purpose and Nature of Processing. Processing activities may include collection, transmission, analysis, comparison, classification, storage, retrieval, security monitoring, and deletion of technical information for:

  • bot detection;
  • fraud and abuse prevention;
  • website and network security;
  • traffic classification;
  • technical diagnostics;
  • Service operation and improvement.

9.7. Customer Responsibilities. The Customer is responsible for:

  • determining whether its use of KillBot complies with applicable privacy and data protection laws;
  • establishing an appropriate legal basis for processing where required;
  • providing visitors with privacy notices or other disclosures where required;
  • obtaining consent where consent is legally required;
  • configuring KillBot consistently with applicable legal requirements;
  • responding to data subject requests for which the Customer is responsible.

9.8. Confidentiality. KillBot will ensure that personnel authorized to process Customer Personal Data are subject to appropriate confidentiality obligations. Access will be limited to personnel who reasonably require it to operate, maintain, secure, support, or improve the Service. Such personnel may include technical support staff, developers, infrastructure specialists, security personnel, administrative personnel, and other authorized personnel involved in providing the Service.

9.9. Security. KillBot will implement reasonable and appropriate technical and organizational measures designed to protect Customer Personal Data against unauthorized access, alteration, disclosure, destruction, loss, or other unlawful processing. Security measures may include access controls, infrastructure security, monitoring, software security measures, and restrictions on internal access according to operational requirements.

9.10. Subprocessors. The Customer authorizes KillBot to use subprocessors where reasonably necessary to provide the Service, including infrastructure, hosting, communications, security, payment, and technical service providers. KillBot remains responsible for requiring subprocessors that process Customer Personal Data on its behalf to provide appropriate data protection obligations consistent with applicable law.

9.11. International Data Transfers. The Customer acknowledges that providing an Internet-based security service may involve processing or transferring data across national borders. Where applicable data protection law requires safeguards for international transfers of personal data, KillBot and the Customer will use an appropriate lawful transfer mechanism as required by such law.

9.12. Data Retention and Deletion. KillBot will retain Customer Personal Data only for as long as reasonably necessary to provide the Service, satisfy legitimate security requirements, or comply with applicable legal obligations. Visitor-level technical and session information is generally automatically deleted within approximately 14–21 days and, under normal operation, no later than 30 calendar days, subject to the exceptions described in Section 8.5. Upon termination of the Service, Customer Personal Data will be deleted or rendered inaccessible in accordance with KillBot's normal retention procedures, except where continued retention is required by applicable law or reasonably necessary for security, fraud prevention, dispute resolution, or enforcement of legal rights.

9.13. Data Subject Requests. Taking into account the nature of the processing, KillBot will provide reasonable assistance to the Customer, where technically feasible and legally required, in responding to requests from individuals exercising rights available under applicable data protection laws.

9.14. Personal Data Breach. If KillBot becomes aware of a confirmed personal data breach affecting Customer Personal Data processed by KillBot on behalf of the Customer, KillBot will notify the affected Customer without undue delay where required by applicable law and provide reasonably available information necessary for the Customer to meet applicable notification obligations.

9.15. Compliance Assistance. Taking into account the nature of processing and information available to KillBot, KillBot will provide reasonable information and assistance necessary for the Customer to demonstrate compliance with applicable processor-related data protection requirements.

9.16. No Sale of Personal Data. KillBot does not sell Customer Personal Data or visitor technical data to third parties for advertising or marketing purposes. KillBot does not use Customer Personal Data for third-party targeted advertising.

9.17. Duration of Processing. This DPA applies for as long as KillBot processes Customer Personal Data on behalf of the Customer.

10. INTELLECTUAL PROPERTY

10.1. KillBot and its Service Content, including its software, detection algorithms, Browser Snapshots technology, interfaces, databases, designs, documentation, trademarks, and other intellectual property, are owned by or licensed to the Provider.

10.2. The Customer receives a limited, non-exclusive, non-transferable right to use the Service during the applicable subscription period and subject to this Agreement.

10.3. Except where expressly permitted by applicable law or this Agreement, the Customer may not copy, reproduce, distribute, publish, modify, reverse engineer, resell, sublicense, or otherwise exploit KillBot's proprietary Service Content without prior written authorization.

11. EMAIL AND SERVICE COMMUNICATIONS

11.1. By creating an Account, the Customer agrees to receive transactional and service-related communications necessary for operation of the Service, including:

  • account and security notifications;
  • password recovery messages;
  • subscription expiration and renewal notices;
  • important Service changes;
  • security and bot detection notifications;
  • technical and administrative messages.

11.2. Marketing communications, where sent, may be unsubscribed from using the unsubscribe mechanism provided in the communication or by contacting KillBot support. Essential transactional or security communications may continue while the Customer maintains an active Account.

12. RIGHTS OF KILLBOT

12.1. KillBot may suspend, restrict, or terminate access to the Service where:

  • the Customer materially violates this Agreement;
  • continued use creates a security risk;
  • the Customer uses the Service for unlawful purposes;
  • required payments are overdue;
  • Customer traffic materially exceeds applicable technical or subscription limits;
  • continued provision of the Service would violate applicable law or binding governmental requirements.

12.2. Where reasonably possible, KillBot will provide notice and an opportunity to remedy the issue before termination, unless immediate action is necessary for security, legal, fraud-prevention, or infrastructure-protection reasons.

12.3. KillBot may delete inactive Projects or Accounts after 360 consecutive days of inactivity, subject to applicable legal requirements and applicable subscription obligations.

13. LIMITATION OF LIABILITY

13.1. To the maximum extent permitted by applicable law, KillBot is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, data, advertising performance, search rankings, or anticipated savings arising from use of or inability to use the Service.

13.2. KillBot is not responsible for failures or delays caused by circumstances outside its reasonable control, including:

  • Internet or telecommunications failures;
  • hosting or infrastructure failures;
  • electrical failures;
  • third-party service outages;
  • payment processor or banking failures;
  • force majeure events;
  • failures of Customer systems or software;
  • malware or security incidents originating within Customer infrastructure.

13.3. KillBot is not responsible for:

  • the security or integrity of the Customer's own website, source code, server, or infrastructure;
  • viruses or malicious software located on Customer systems;
  • failures in Customer software;
  • decisions made by search engines, advertising networks, analytics platforms, or other third-party services;
  • changes in website rankings, traffic, conversions, advertising performance, or search engine visibility;
  • third-party services integrated with KillBot.

13.4. Bot detection is inherently probabilistic. KillBot does not warrant that the Service will detect every automated visitor, prevent every malicious action, or produce zero false-positive or false-negative classifications.

13.5. Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

14. TERMINATION

14.1. This Agreement becomes effective when the Customer accepts it by registering for, purchasing, accessing, integrating, or using the Service.

14.2. The Agreement remains effective while the Customer continues to use the Service.

14.3. The Customer may terminate use of the Service by cancelling the applicable subscription and discontinuing use of KillBot, subject to any outstanding payment obligations.

14.4. KillBot may terminate or suspend the Agreement and Service in accordance with Section 12.

14.5. Following termination, provisions that by their nature should survive termination, including intellectual property, confidentiality, limitation of liability, payment obligations, and applicable data protection obligations, will remain effective.

15. ELECTRONIC COMMUNICATIONS AND DOCUMENTS

15.1. The parties may use electronic communications and electronic document management systems for contracts, invoices, notices, and other legally significant documents where permitted by applicable law.

15.2. Electronic signatures may be used where recognized under applicable law.

15.3. A Customer using KillBot without a separately negotiated agreement remains bound by this EULA.

16. CHANGES TO THE SERVICE AND AGREEMENT

16.1. KillBot may update the Service, available functionality, technical architecture, subscription plans, and this Agreement from time to time.

16.2. Where changes materially affect the Customer's rights or obligations, KillBot will provide reasonable advance notice where required by applicable law.

16.3. Continued use of the Service after an updated Agreement becomes effective constitutes acceptance of the updated Agreement to the extent permitted by applicable law. If applicable law requires explicit consent to a particular change, KillBot will request such consent.

17. GOVERNING LAW AND MANDATORY RIGHTS

17.1. The parties' contractual relationship may be subject to the governing law specified in the applicable order, marketplace agreement, commercial agreement, or other contract between KillBot and the Customer.

17.2. Where no separate governing-law provision applies, disputes will be governed by the law applicable to the Provider, without prejudice to mandatory consumer protection, privacy, or other rights that cannot legally be waived in the Customer's jurisdiction.

17.3. If any provision of this Agreement conflicts with mandatory applicable law, that mandatory law will prevail only to the extent of the conflict, and the remaining provisions of this Agreement will continue in effect.

18. THIRD-PARTY MARKETPLACES

18.1. KillBot may be offered through third-party marketplaces, including Alibaba Cloud Marketplace.

18.2. Where the Customer purchases KillBot through a third-party marketplace, the marketplace's applicable billing, ordering, taxation, cancellation, and transaction terms may apply in addition to this Agreement.

18.3. If there is a conflict between this Agreement and mandatory marketplace transaction terms, the marketplace terms will govern the relevant marketplace transaction, while this Agreement will continue to govern use of the KillBot Service to the extent not inconsistent with those terms.

19.2. Service access and account management are available at https://my.kill-bot.net/.

19.3. For privacy or data processing requests, Customers may contact KillBot using the support contact information published on the KillBot Website.

DATA PROCESSING AGREEMENT SUMMARY

For clarity, Section 9 of this EULA constitutes the Data Processing Agreement ("DPA") between the Customer and KillBot and is incorporated into and forms an integral part of this EULA.

By accepting this EULA, the Customer also accepts the DPA contained in Section 9.
